Drivers suspected of driving under the influence in Florida who refuse the standard Breathalyzer test may soon face two alternatives: either a one-year suspension of their driver’s license or the installation of an ignition interlock device for the same duration.

A first conviction for driving under the influence in Florida carries hefty penalties, including possible imprisonment and probation — so, many individuals opt to refuse the Breathalyzer test in hopes of evading conviction.

Across the U.S., the average refusal rate is 24%. But, according to a state Senate bill analysis, Florida’s refusal rate is much higher — at 35%.

However, if you have a driver’s license, that means you’ve already given your “implied consent” to be tested for drugs or alcohol if a law enforcement officer suspects you are driving under the influence.

Under current Florida law, declining a Breathalyzer test can lead to a one year suspension of driving privileges — a consequence some drivers view as insignificant, especially if they intend to continue driving with a suspended license.

But doing so can lead to more serious consequences, including fines and jail time.

Florida Senate Bill 260 — which passed the Senate on March 1, with a 32-1 vote, offers another option — in lieu of a suspended license, drivers would have the choice to install a handheld breath-analyzing ignition interlock device in their car, one that prevents users from starting their vehicle if they’ve consumed alcohol.

Its House companion bill has yet to be voted on.

According to the National Highway Traffic Safety Administration, alcohol impaired driving recidivism rates were 75% lower for drivers with ignition interlock devices installed.

Drivers who choose this option would be responsible for the costs, which range from $70 to $170 for installation and $50 to $120 per month for device leasing and monitoring.
