A portion of the recovered funds, discovered through post-audits and subsequently deposited into the state budget, will be allocated to fund the operation and capacity building of the inspection agency
Continuing the 8th Session, under the chairmanship of National Assembly Chairman Tran Thanh Man and the direction of National Assembly Vice Chairwoman Nguyen Thi Hong, the National Assembly Standing Committee considered and approved the draft Resolution stipulating that inspection agencies are allowed to allocate a portion of the funds recovered or discovered through inspections, after depositing them into the state budget, to cover operational expenses and enhance the capacity of the inspection agencies (Resolution).

After consideration, the Standing Committee of the National Assembly voted to approve the Resolution with a 100% approval rate.
Earlier, the Standing Committee of the National Assembly heard presentations from Deputy Inspector General of the Government
Le Tien Dat and Deputy Chair of the Economic and Financial Committee Pham Thuy Chinh on the summary of the Submission and the Verification Report of the draft Resolution.

According to Deputy Speaker of the National Assembly Nguyen Thi Hong, the draft Resolution has been reviewed and commented on in writing by the Standing Committee of the National Assembly, and a concluding notice has been issued. The Government has directed the Government Inspectorate to coordinate with relevant agencies to review and finalize the draft Resolution.
The draft Resolution is intended to replace Resolution No. 37/2023/UBTVQH15 on ensuring funding for operations and enhancing the capacity of inspection agencies as stipulated in Clause 3, Article 59 of the 2025 Inspection Law.

The provisions regarding the allocation rate, the amounts to be allocated, and the procedures for budget preparation, allocation, and settlement remain essentially the same as in Resolution No. 37. Some changes include: the allocation threshold; the eligible recipients; the removal of bonuses and incentives for inspection officers; and the expansion of expenditure categories to include strengthening database development, implementing policies to attract and utilize talented individuals, and other necessary tasks.
In particular, the draft Resolution has added the principle of ensuring that budget estimates do not overlap or duplicate with items already allocated from the state budget and other funding sources; it also adds a transitional provision regarding the allocation of funds for inspection agencies that take over the functions and tasks of inspection agencies that have ceased operations due to organizational restructuring. This provision will include the total amount of money discovered, recovered, and actually paid into the state budget by the former inspection agency, but which has not yet been allocated.

Based on the opinions expressed at the session, concluding on this matter, Vice Chairwoman of the National Assembly Nguyen Thi Hong stated that the Standing Committee of the National Assembly basically agrees with the Government's proposal to issue a Resolution of the Standing Committee of the National Assembly stipulating that inspection agencies are allowed to deduct a portion of the recovered funds discovered through inspections, after depositing them into the state budget, to cover operating expenses and enhance the capacity of the inspection agencies according to a simplified procedure.
The Standing Committee of the National Assembly basically agreed with the Government's proposal to use the retained funds to cover operating expenses and enhance the capacity of inspection agencies.

The Standing Committee of the National Assembly requests the Government to direct the drafting agency to coordinate with relevant agencies to fully incorporate and explain the opinions from the review and the opinions expressed at the Standing Committee's meeting, mainly by clarifying the information in the dossier and the submission; to review and revise the draft Resolution to ensure clarity regarding the purpose, target, and effective date of implementation, avoiding overlapping or duplication of expenditure tasks, and conforming to the provisions of the law on budget management and use and related laws.

In particular, the Standing Committee of the National Assembly requested further clarification of the conditions for using funds and the scope of expenditures for other necessary tasks; a review of transitional regulations regarding the receiving agency, the timing of budget submission, and the applicable budget year for aggregated items, to avoid duplication. "The clearer these issues are defined, the smoother the implementation, inspection, and supervision process will be," the Vice Chairman of the National Assembly emphasized.

The Standing Committee of the National Assembly has assigned the Standing Committee of the Economic and Financial Committee to coordinate with the Government Inspectorate and relevant agencies to urgently review and finalize the draft Resolution.
